Respectful behaviour is the cornerstone of a company’s culture. It reflects on the owner’s values to make the workplace safe. POSH is built on legal guidelines that aim to help employees to raise their voice when inappropriate behaviour ruins their mental health. Indian companies are waking up to POSH training for employees as they collaborate with global partners to do business.

The Posh Act was introduced in 2013 in India. It targets the protection of women employees working for long hours in India in the public and private sectors. All employers need this system in place for any worker to complain and get justice.

The management should have:

  • An internal committee to handle the cases.
  • Put into place anti-harassment policies.
  • Conduct awareness programs for the staff regularly.
  • There should be no fear of retaliation towards the complainant.
  • Submission of report to relevant authorities annually.

Any organisation failing to follow the rules risks its reputation in the market and can be fined.

POSH training, India

Many employers are still not fully aware of the consequences of non-compliance with POSH training. In India, the ‘MeToo movement’ accelerated the formation of the Prevention of Sexual Harassment. It took social media by storm and continues to impact employees and employers. The female staff often are subjected to visual, verbal, and physical harassment. The POSH Act is a vital one-stop solution to punish erring parties. The Ministry of Women and Child Development has formulated it. All employers need to conduct training programs for awareness regularly.

In 2023, there was an update on the policy for the benefit of the complainant.

If the committee can’t complete the inquiry process in 90 days as per the updates under Section 11(4) of the POSH Act, 2013, the inquiry will not be rejected as invalid.

The 90-day timeline cannot be made mandatory.

With this amendment, a case cannot be dropped. If the investigation continues for more than 90 days, it will remain valid. Improving productivity is important. When people are in a good frame of mind, they work better.

Employee Crossings is committed to helping organisations take remedial action and handle redressals effectively. We hold POSH training for employees and help workplaces to remain safe and controlled.
